The lien affidavit must be filed with the County Clerk’s Office in the county where the property is located by no later than the 15th day of the fourth month from when you last worked at the project, excluding punch work and warranty work.
NOTE: The deadline to file a Lien is not extended if the 15th falls on a Saturday, Sunday, or legal holiday. If your deadline falls on one of these days, file the Lien Affidavit on the preceding business day. The Lien Affidavit must actually be filed, not simply placed in the mail or waiting at the clerk’s office to be filed.
LIEN FILING CALENDAR
In the left-hand column, locate the month that you provided labor and/or materials to the project and for which you have not yet been paid. In the corresponding right-hand column, is the deadline for filing a lien for money owed for the labor and/or materials provided to the project in that month.
|MONTH OF “ACCURAL OF INDEBTEDNESS”||FILE LIEN ON OR BEFORE DATE|
For example, if you have a direct contract with the property owner and you completed your work in January, then you must file your lien on or before May 15.
Another example: if you are a first-tier or a second-tier subcontractor who completed work in April, then you must file your lien on or before August 15.
